GENERAL INFORMATION
These General Conditions of Sale concern the purchase of VIVO VINTAGE products carried out remotely via computer network on the website www.vivovintage.com, belonging to Allegra Srls , with headquarters in Venafro (IS), Via Santa Ormisda, 52. Each purchase transaction will be governed by the provisions of Legislative Decree 185/99, Legislative Decree 206/05; the information directed to the conclusion of the contract will be submitted to the art. 12 of Legislative Decree. 70/03 and, as regards the protection of confidentiality, will be subject to the legislation referred to in Legislative Decree 196/03.
CONCLUSION OF THE CONTRACT AND ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
The contracts for the sale of products on the website www.vivovintage.com are considered concluded when the purchase order placed by the customer is sent to VIVO VINTAGE di Allegra Srls and the latter accepts it. VIVO VINTAGE of Allegra Srls will promptly send the customer the receipt of the purchase order made by the same.
The customer, by sending his purchase order electronically, declares that he has read and accepted the present general conditions of contract and undertakes to observe and respect them in his relations with VIVO VINTAGE di Allegra Srls .
VIVO VINTAGE by Allegra Srls pursuant to art. 13 of Legislative Decree 196/2003 informs that the personal and fiscal personal data acquired even verbally in reference to the commercial relationships established, provided directly by the interested parties, or otherwise acquired in the context of the company's activity, will be processed in compliance with the aforementioned legislation , including the confidentiality obligations envisaged by these.
In relation to the aforementioned, the rights referred to in article 7 of Legislative Decree 196/2003.
The Customer is required, before submitting his purchase order, to carefully read these general conditions of sale. The forwarding of the purchase order implies their full knowledge and their acceptance.
Finally, once the online purchase procedure has been concluded, the Customer is required to print and keep these general conditions of sale, which have already been viewed and accepted during the phase of concluding the contract.
By sending the order online, the Customer sends VIVO VINTAGE di Allegra Srls a proposal to purchase the product and/or products included in the cart. When the Customer places an online order for the products he has placed in the cart, he agrees to purchase them at the price and terms indicated in these General Terms and Conditions of Sale.
VIVO VINTAGE di Allegra Srls will communicate to the Customer the acceptance and confirmation of the order.
In particular VIVO VINTAGE di Allegra Srls will not accept orders:
- if the material, at the time of the order, is not available in the warehouse and/or
- if the Customer cannot or does not want to pay using credit cards (Paypal), bank transfer or Paypal. It is possible to place an order both through the website www.vivovintage.com at the prices and conditions indicated therein and from authorized dealers.
The customer purchases the product, the characteristics of which are illustrated online in the relative descriptive and technical sheets, at the price indicated therein plus the delivery costs specified on the site.
Before forwarding the purchase order, the unit cost of each selected product is summarized, as well as the total cost in the event of the purchase of several products and the relative delivery costs.
Once the purchase order has been submitted, the customer will receive an e-mail message from VIVO VINTAGE di Allegra Srls confirming receipt of the purchase order and containing information relating to the main characteristics of the purchased good, detailed indication of the price, delivery costs, applicable taxes and means of payment and containing a reference to the general contract conditions and information about the existence of the right of withdrawal, the conditions and methods of its exercise displayed on the site. Following the approval of the Decree Law 4 July 2006 n. 223 "maneuver bis" Art. 37 paragraphs 8 and 9, converted with Law 248 of 4 August 2006, which entered into force on 12 August 2006, which restores the obligation to communicate the list of customers and suppliers in the event of an issue invoice, and of the Decree Law 78 of 31 May 2010 converted into Law 122 of 30 July 2010, imposes the need to request customers to communicate VAT NUMBER and TAX CODE in the appropriate fields on the site.
The customer can make the payment due by choosing one of the following methods listed.
- Payment by credit card: In the event that the consumer intends to pay by credit card, he can use the payment procedure with PayPal , which is suitable for ensuring the confidentiality of the data provided by the customers. For any information and further Legal Agreements, the Customer is referred to consult the website www.paypal.com .
- Payment by bank transfer: Payment by bank transfer can be made using the following details:
In the event that payment is made by bank transfer, the purchased good will be shipped in the manner described in the following paragraph "Delivery of Products", to the address indicated by the customer upon receipt of the credit, therefore on average within two/five days after the execution of the transfer (the timing varies according to the credit institution used). To facilitate the process, the payment receipt together with your order number can be sent by Fax to: 346/7350973 or by e-mail to: info@vivovintage.com .
The purchased good, together with the relative invoice, is delivered by courier to the address specified by the Customer when ordering online. Any specific needs must be presented by the customer to VIVO VINTAGE di Allegra Srls .
VIVO VINTAGE di Allegra Srls guarantees delivery of the goods within 15 (fifteen) working days from the date of receipt of the confirmation of the transaction.
In the event that the customer chooses the cash on delivery method of delivery, payment must be made exclusively by cash or cashier's check, to be delivered directly to the courier upon receipt of the goods.
If VIVO VINTAGE di Allegra Srls fails to guarantee delivery within the aforementioned terms, a further 10% discount will be applied to the total cost of the reference VIVO VINTAGE di Allegra Srls items.
In the event of non-delivery due to the recipient's absence at the address indicated by him in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender ( VIVO VINTAGE by Allegra Srls ).
WARRANTY OF CONFORMITY AND DEFECTIVE PRODUCTS
The products purchased on the website www.vivovintage.com are subject to the regulation on the sale of consumer goods. The delivered products comply with the characteristics illustrated online in the relative descriptive and technical sheets.
VIVO VINTAGE di Allegra Srls is liable to the customer for any lack of conformity existing at the time of delivery of the goods.
The consumer has the right to exercise the right of withdrawal. In particular, the consumer has the right to withdraw from any contract concluded with VIVO VINTAGE di Allegra Srls, without any penalty and without specifying the reason, within the term of 14 (fourteen) working days starting from receipt of the goods.
The right of withdrawal is recognized by the consumer in relation to any goods purchased by him on the website www.vivovintage.com.
METHOD FOR THE EXERCISE OF THE RIGHT OF WITHDRAWAL
The right of withdrawal is exercised by sending, within the aforementioned term, a written communication to the address of VIVO VINTAGE di Allegra Srls by registered letter with acknowledgment of receipt.
The notice of withdrawal can also be sent, within the same term, by telegram or fax, provided that it is confirmed by registered mail with return receipt within the following 48 hours.

If the goods have been delivered, the customer is required to return them to VIVO VINTAGE di Allegra Srls within 14 (fourteen) working days starting from the date of delivery of the goods.
The good must be returned to VIVO VINTAGE di Allegra Srls complete with all accessories, instruction manuals and everything originally delivered to the customer, as well as packed in its original wrapping. The returned product must be accompanied by a copy of the electronic receipt of the order. The costs of returning the goods to VIVO VINTAGE di Allegra Srls are charged to the customer.
If the right of withdrawal is exercised by the customer in accordance with the provisions contained in this clause, VIVO VINTAGE di Allegra Srls is required to reimburse the sums paid by the customer.
In particular, VIVO VINTAGE di Allegra Srls will proceed free of charge with the transmission of the re-credit order relating to the cost of the goods shipped including shipping costs within 30 (thirty) days from the date on which it became aware of the exercise of the right of withdrawal from part of the customer. This operation will be carried out through the credit institution issuing the credit card used for the payment or by crediting the sum to the bank account indicated by the customer.
VIVO VINTAGE di Allegra Srls has the right to reject any product returned in ways other than those specified above, as well as products for which the return costs have not been paid in full by the customer, or the methods and times indicated have not been respected for the communication of the exercise of the right of withdrawal.
In the event of total or partial non-payment of the purchase price of the VIVO VINTAGE asset by Allegra Srls , it reserves the right to declare pursuant to and by effect of art. 1456 of the civil code terminated this contract by sending a written communication to the customer's e-mail address.
For any complaint or clarification, the customer must contact the number 346/7350973 or the e-mail address info@vivovintage.com . The customer will be contacted for clarification within 3 (three) working days of the request.
APPLICABLE LAW AND JURISDICTION
This contract is regulated by the Italian law. The exclusive jurisdiction and venue for any legal action brought by the Purchaser pursuant to this guarantee or any further legal guarantees will be the Court of Isernia. In the event of victory for VIVO VINTAGE di Allegra Srls in any legal action, the plaintiff will have to reimburse VIVO VINTAGE di Allegra Srls for the expenses, including lawyers' fees and court costs, incurred by VIVO VINTAGE di Allegra Srls for your own defence.
REFERRAL
For anything not expressly provided for in this contract, the rules of Italian law in force apply.
